Information on Used Items
§ 1 Sale "As Described and Seen" (1) All items marked as "used" are sold with explicit reference to their respective condition. The product description, supplemented by photographs, constitutes the agreed quality of the item. (2) By purchasing, the customer acknowledges the described condition. Since the item is purchased "as described," any subsequent complaint or rescission based on features that were already visible in the description or photos is excluded.
§ 2 Exclusion of Rescission upon Knowledge A rescission of the contract (return against refund of the purchase price) is excluded if the customer was aware of the condition of the item at the time of purchase. This applies in particular to signs of wear, optical defects, or technical limitations that were explicitly mentioned in the product description.
§ 3 Warranty Period The statutory warranty period for used goods is limited to 12 months. This liability refers exclusively to hidden defects that were not listed in the description at the time of purchase and which unexpectedly impair functionality.
§ 4 No Replacement Delivery As these are unique items, replacement delivery is excluded. In the event of a valid hidden defect, repair (rectification) takes absolute priority over a return.
